1. Introduction

Welcome to Permadata Baja Well ("we," "our," or "us"). By accessing or using our website, services, or products, you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using Permadata.

Permadata provides data persistence solutions, including local storage management and cloud syncing capabilities across different subscription tiers. These Terms govern your access to and use of our services, including any updates, new features, and programs associated with Permadata.

2. Acceptable Use

You agree to use Permadata only for lawful purposes and in accordance with these Terms. You are responsible for all activities that occur under your account.

You agree not to:

  • Use Permadata in any way that violates any applicable federal, state, local, or international law or regulation
  • Attempt to bypass or abuse our cloud syncing capabilities or storage limits
  • Use automated scripts to access, monitor, or interact with our services in a manner that could degrade service quality for other users
  • Attempt to gain unauthorized access to any part of our services, other accounts, or computer systems
  • Interfere with or disrupt the integrity or performance of Permadata or third-party data contained therein
  • Store or transmit malicious code, viruses, or harmful data through our service
  • Resell, white-label, or otherwise redistribute our services without explicit written permission

3. Account Registration

To access certain features of Permadata, particularly our premium cloud syncing capabilities, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

4. Payment Terms

Permadata offers both free and paid subscription plans. By selecting a paid subscription plan, you agree to pay all fees associated with the plan you choose.

4.1 Subscription Fees

Our Basic and Pro plans require payment of subscription fees. All payments are processed securely through Stripe. Fees are billed in advance on either a monthly or annual basis, depending on the billing cycle you select.

4.2 Free Trial

We may offer a free trial period for our premium services. At the end of the trial period, your account will automatically be charged for the subscription unless you cancel before the trial ends.

4.3 Refunds

All subscription fees are non-refundable except where required by law. In exceptional circumstances, we may, at our sole discretion, offer a partial or full refund.

4.4 Price Changes

We reserve the right to adjust pricing for our services. If we change pricing, we will provide notice of the change on our website or by email at least 30 days before the change takes effect.

5. Termination

We reserve the right to suspend or terminate your access to Permadata, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, infringes on the rights of others, or is harmful to the interests of our users, partners, or us.

If your account is suspended or terminated for violations of these Terms:

  • You may lose access to your stored data, particularly data stored in our cloud services
  • We may retain your data for compliance with legal obligations
  • No refunds will be provided for any unused portion of paid subscriptions
  • You remain liable for all amounts due up to the date of termination

6. Liability and Warranty Disclaimers

6.1 Free Tier Limitations

For users of our free tier, Permadata is provided on an "as is" and "as available" basis. While we strive to provide reliable local persistence, we make no guarantees regarding data loss in the free tier. We strongly recommend regular backups of important data.

6.2 Premium Services

For paid subscription plans, we will make commercially reasonable efforts to ensure data availability and integrity. However, we do not guarantee 100% uptime or data preservation in all circumstances, including but not limited to force majeure events, hardware failures, or network issues beyond our control.

6.3 Limitation of Liability

To the maximum extent permitted by law, in no event shall Permadata, its affiliates, or its licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, our services. Our total liability for any claim arising out of these Terms shall not exceed the greater of $100 or the amount you have paid us in the past 12 months.

7. Intellectual Property

Permadata and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You retain all rights to your data stored using our services. By using Permadata, you grant us a limited license to host, transfer, display, and use your data solely as necessary to provide our services to you.

8. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through our website or by email. Your continued use of Permadata after such modifications constitutes your acceptance of the revised Terms.
